Terms of Service (Draft)

Last updated: draft pending legal review

1. Parties and acceptance

These terms are between you and Truth Excellence Group LLC. By using our website or services, you accept them. The legal entity details will be confirmed in the final version.

2. Services

We provide two kinds of work: Lane A, website and software builds with optional monthly Care Plans, and Lane B, custom live fan experiences built for events and organizations.

3. Scope and change requests

Each project has a defined scope. Requests outside that scope are treated as change requests, quoted first, and billed at our out-of-plan rate (about $110/hr).

4. Payment

Builds are billed 50% upfront and 50% at launch. Late payments may pause work. Care Plans are billed monthly, and cancellation terms are described in your plan agreement.

5. Refunds

Refund terms, including the event-deposit guarantee if adopted, will be written into your individual agreement.

6. Revisions and acceptance

Each project includes an agreed number of revision rounds. A project counts as "launched" when it is made live or delivered as defined in your agreement.

7. Ownership and licenses

You own your content. We keep ownership of our platform, templates, and reusable components, and license them to you as described in your agreement, including any hosting handoff terms.

8. Client responsibilities

You are responsible for having the rights to the content you provide, giving us accurate information, and following the contest and giveaway laws that apply to your event.

9. Voting disclaimer

"For entertainment, People's Choice, and event competition use only. Not for government or political elections."

10. Giveaways and contests

The organizer is responsible for the official rules and for the sweepstakes legality of any giveaway or contest run at their event.

11. Acceptable use

Fans must use our experiences lawfully and respectfully. Uploaded content and photo-wall submissions may be moderated and removed at our or the organizer's discretion.

12. Uptime and support

We publish uptime and support targets as goals. They are not guarantees unless written into your contract.

13. Third-party services

Our services rely on third parties such as payment processors, SMS providers, and hosting companies. Their own terms may also apply to your use.

14. SMS program

Where an event offers text-message updates, fans opt in through a separate, unchecked consent box that states message and data rates may apply, that message frequency varies, and that consent is not a condition of purchase. Reply STOP to cancel or HELP for help at any time; opted-out numbers are not messaged again. Placeholder pending legal review.

15. Fan data

Fan registration, verification, and consent records collected at an event belong to the organizer's relationship with their fans. Organizers must collect consent lawfully, honor deletion requests, and use exported lists only for the consented purpose. Placeholder pending legal review.

16. Warranties, disclaimers, and limitation of liability

Except as written in your agreement, services are provided "as is," and our liability is limited as described in the final terms.

17. Indemnification

You agree to indemnify us against claims arising from your content, your event, or your breach of these terms.

18. Governing law, disputes, and changes

These terms are governed by Nevada law. Dispute resolution details will be set out in the final version, and we may update these terms with notice.

19. Paid fan access (draft placeholder)

Some events may offer optional paid "bonus vote" bundles. Paid votes are processed by Square; we never see or store card details. Paid votes are granted only after Square confirms payment, are labeled separately from free votes, and never close or restrict free voting, which remains open to everyone. Whether paid votes are offered, and how they count, is set by the event organizer under their own official contest rules. Except where required by law, all sales are final; refund requests are handled by the organizer. Placeholder pending legal review.
